Theists: Do you think certain laws should be trumped if it is required for certain religious freedoms?

Native religions have a "grandfather" clause when it comes to ritual drug abuse (they were probably using drugs in their rituals before the Europeans "discovered" their lands). They can claim a 1st ammendment violation if the DEA enforces their policies on them. However, an individual or a start-up religion can not.
